General Terms and Conditions and Brokerage Regulations
1. Instruction / Brokerage Agreement
Requests for our offers shall be deemed an instruction to engage us and simultaneously constitute acceptance of our commission rates.
2. Entitlement to Commission
Our entitlement to commission arises as soon as a contract regarding the property named by us is concluded based on our evidence and/or brokerage activities. It is sufficient if our activity has contributed causally to the conclusion of the contract.
3. Other Contracts and Subsequent Transactions
Any type of contract concluded through the establishment of contact between the contracting parties by us is also subject to a commission. We are also entitled to a commission if, in temporal and/or economic connection with the first contract brokered or evidenced by us, further contractual agreements are concluded between you and your contracting partner that are attributable to the existing brokerage agreement. If, instead of the rental/lease offered in the exposé/offer, a purchase of the property is concluded, a commission of 3.57% to 7.14% of the purchase price including statutory VAT shall be payable. If, instead of the purchase offered in the exposé/offer, a rental/lease of the property is concluded, a commission of 3.57 to 7.14 months’ rent including VAT shall be payable.
4. Commission Rates
The rates stated in our offers, proof letters, exposés, and NDAs are agreed upon upon conclusion of the brokerage agreement (see Section 1) or upon receipt of the offer, proof letter, or exposé between you and us, and are payable to Gerstein Immobilien upon successful brokerage or evidence of a transaction. Our commission rates are specified in the respective offer.
5. Information in Our Offers
All information contained in our offers is based on information provided by the seller, owner, landlord, lessor, or their authorized representatives. Despite careful verification, Gerstein Immobilien assumes no responsibility for the accuracy or completeness of the information provided. Errors and prior sale/rental remain reserved.
6. Confidentiality
Our offers and communications are intended solely for the recipient and must be treated as confidential and may not be disclosed to third parties. If a contract with a third party is concluded as a result of unauthorized disclosure, we shall be entitled to a commission from you in the amount that would have been payable in the case of a direct transaction.
7. Prior Knowledge
If you are already aware of the opportunity to conclude a contract disclosed by us, you are obliged to inform us immediately, but no later than within three calendar days, providing evidence or the source of your knowledge. Otherwise, our offers shall be deemed causal and accepted, and a commission shall in any case be payable upon conclusion of a contract regarding the property disclosed by us.
8. Due Date of Commission Claim
Our commission becomes due upon conclusion of the main contract. The commission is payable within 7 days of invoicing without deduction.
9. Activity for Third Parties
We are entitled to act for the other contracting party, either for a fee or free of charge.
10. Hourly Fee
For all services used, we charge the client an hourly rate of EUR 130.00 plus 19% statutory VAT.
11. Place of Performance and Jurisdiction
The place of performance and jurisdiction is Munich, Germany.
